YOU MUST BE OVER 18 TO PURCHASE GOODS FROM OUR SITE. WE VERIFY YOUR AGE BEFORE FULFILLING YOUR ORDER.
1. These Terms
1.1 What these terms cover. These are the terms and conditions on which we supply e-cigarette and related products to you.
1.2 Why you should read them. Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem, and other important information. If you believe there is a mistake in these terms, please contact us to discuss.

2.3 How we may contact you. If we need to contact you, we will do so by telephone or by writing to you at the email or postal address provided in your order.
2.4 "Writing" includes emails. When we use the terms "writing" or "written" in these terms, this includes emails.
3. Our Contract with You
3.1 How we will accept your order. Our acceptance of your order takes place when we email you to confirm it. At this point, a contract is formed between you and us.
3.2 If we cannot accept your order. If we cannot accept your order, we will inform you by email and not charge you for the product. This may be due to the product being out of stock, an error in the price or description, inability to verify your age, or other reasons.
3.3 Your order number. We will assign an order number to your order and provide it to you. Please use this number whenever contacting us about your order.
3.4 We only sell goods to consumers in the UK. We only supply goods to consumers in the UK and members of the British Armed Forces serving abroad via the BFPO.
3.5 You must be over 18 to purchase. It is illegal for us to sell e-cigarettes or related products to anyone under 18 years of age.
3.6 Verification of your identity. We conduct electronic verification to ensure you are over 18. If we cannot verify your age electronically, you may need to provide documentary proof (e.g., a passport or driving license). We will not dispatch products until your age is verified. If we cannot verify your age and you do not provide documentation, we will cancel your order and refund any payments made.
4. Our Products
4.1 Products may vary slightly from images. The product images on our website are for illustrative purposes only. While we strive to accurately display product colors, the actual product may differ slightly.
4.2 Product packaging may vary. Packaging may differ from images shown on our website.
4.3 Product safety. E-cigarettes may have associated safety risks. Please review the product instructions and our safety guides before using the products.
5. Your Rights to Make Changes
If you wish to make changes to your order, please contact us. We will let you know if the change is possible and any potential impact on price or delivery.
6. Our Rights to Make Changes
6.1 Minor changes to the products. We may change the product: (a) To reflect changes in relevant laws and regulations, or (b) To make minor technical adjustments to improve safety.
7. Providing the Products
7.1 Delivery costs. Delivery costs will be displayed on our website during the order process.
7.2 Delivery timing. We aim to deliver your order within 30 days unless otherwise specified.
7.3 Delays outside our control. If delivery is delayed due to events outside our control, we will notify you as soon as possible. You can cancel the order if delays are substantial.
7.4 If you are not at home for delivery. If no one is available to receive the delivery, you may need to rearrange or collect it from a local depot.
7.5 If you do not rearrange delivery. If the product is returned to us after failed delivery attempts, we may charge you for storage or redelivery.
7.6 Responsibility for the goods. You become responsible for the goods upon delivery to your specified address.
7.7 When you own goods. Ownership of the goods passes to you when we dispatch them.
8. Your Rights to End the Contract
8.1 Your rights to end the contract. Your rights will depend on whether there is anything wrong with the product or if you change your mind.
8.2 Ending the contract because of something we have done. If you are ending the contract due to our actions (e.g., incorrect product description or delivery delay), we will refund you in full.
8.3 Your right to change your mind. You have 14 days from receipt of goods to change your mind and receive a refund, subject to deductions as outlined in clause 9.
8.4 When you do not have the right to change your mind. Products sealed for health or hygiene reasons (e.g., vape kits) cannot be returned once unsealed.
9. How to End the Contract
9.1 Contact us. To end the contract, contact us at sales@sparksecigs.co.uk.
9.2 Returning products. If you are returning products, please send them back within 14 days.
9.3 Refunds. We will refund you the price paid for the products, including delivery costs, minus any deductions for handling the products.
10. Our Rights to End the Contract
We may end the contract if you do not comply with its terms, such as failing to take delivery of the products.
11. If There is a Problem with the Product

12. Price and Payment
12.1 Price. The price for the product (including VAT) is shown during checkout.
12.2 Payment. You must pay for the products before we dispatch them.
13. Our Responsibility for Loss or Damage
13.1 Responsibility. We are responsible for foreseeable loss or damage caused by us but are not responsible for any business losses.

15. Other Important Terms
15.1 Transfer of agreement. We may transfer this agreement to someone else but will notify you in writing.
15.2 Your rights. You may only transfer your rights to someone else with our written consent.
15.3 Legal jurisdiction. These terms are governed by English law, and you can bring legal proceedings in English, Welsh, Scottish, or Northern Irish courts, depending on your place of residence.
